For more than a half-century, evidence scholars have been exploring whether the criminal standard of proof can be grounded in decision theory. Such grounding would require the emergence of a social consensus about the utilities to be assigned to the four outcomes at trial. Significant disagreement remains, even among legal scholars, about the relative desirability of those outcomes and even about the formalisms for manipulating their respective utilities. We attempt to diagnose the principal reasons for this dissensus and to suggest (...) ways in which a broadly shared evaluation might be forged, both with respect to the appropriate equations for defining the standard of proof and with respect to the appropriate utilities to associate with the various trial outcomes. Where consensus cannot be forged, we hold that remaining differences can probably be finessed. We also suggest ways to elicit the utilities of individuals on these matters so as to avoid the usual flaws of such surveys. Along the way, we note a). the disproportionate role that the Blackstone ratio of errors continues to play in appraisals of the utilities of trial outcomes (despite its unintelligibility in the context of utilities) and b). the persisting belief -for which there is no theoretical basis-that every plausible assignment of utilities will inevitably result in a very high standard of proof. This discussion adjudicates a dispute between Larry Laudan and Gerald Doppelt over the nature of methodological rules. Laudan holds that all methodological rules are hypothetical imperatives, while Doppelt argues that a subset of those rules, basic methodological standards, are not hypothetical imperatives. I argue that neither writer offers a satisfactory account of methodological rules and that their reliance on the hypothetical/nonhypothetical distinction does not advance our understanding of methodological rules. In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 475 whereas in some texts Aquinas explicitly teaches that the higher senses of vision and hearing are the ones that mainly (praecipue, principaliter) lead to aesthetic experience.t5 Moreover, the statement that only in the thirteenth century was the question of the distinction between the higher and lower senses explicitly raised (p. l13f.), is true only if the author meant to exclude the pre-medieval or patristic as well (...) as the ancient period of philosophy.16 Finally, there is one technical weakness in this book that cannot be left unmentioned. The overwhelming majority of references are not to the original medieval texts treated and/or quoted in the three-volume edition, but to the number of volume and page in that edition. Thus the reader must be both familiar with French and in possession of the original three-volume work, or remain hopelessly frustrated every time he wishes to consult the original texts or at least know which texts are being mentioned. Yet, if one knows French, he does not need the English translation; and if he is also fortunate enough to have access to the original three-volume version, he will not need the abridged version of the original work at all. For this reason, should there be a second edition of this translation, the references should be changed from the l~tudes to the original medieval works. Although the negative remarks are more lengthy in this review than the positive evaluation is, it would be a grave mistake to conclude from this that the defects outweigh the value of the book. As a matter of fact, upon finishing the reading of this translation of De Bruyne's work, this reviewer was left with the conviction that, in the final balance, the reader can only greatly benefit from this work, and we all owe gratitude to the translator for having made this highly informative work available in the English language. Risse, and C. Vasoli have pointed out the vitality and significance associated with the development of the logical thought of the period. The general question of methodology has produced an enormous scholarly literature in recent years,I but much remains to be done before we fully understand how various methodologies have evolved and what relation philosophical discussions of method have had to the actual practice of science. Unfortunately, Crescini's book is on the whole disappointing, although nearly everyone will find the odd bit of information of which he was not previously aware. It definitely does not, however, establish a solid foundation for later studies. The book is organized into three principal parts, dealing with the development of the analytic method in logic (pp. 21-188), in the natural sciences (pp. 189-284), and in mathematics (vv. 285-328). Like most philosophers, Laudan [7] believes that by and large science makes cognitive progress and that the development of science is more or less rational. Social responsibility is intertwined with nursing; however, perceptions of Iranian nurses about social responsibility has not been explored yet. This study, as part of a larger qualitative grounded theory approach study, aims to explore Iranian nurses’ perception of social responsibility. The study participants included 10 nurses with different job levels. The study data were generated through semi-structured interviews. The participants were selected through purposeful sampling approach, which was then followed by theoretical sampling until reaching the point of data saturation. All (...) the interviews were recorded, transcribed, and analyzed through constant comparative analysis. Positive human characteristics, professional competencies, professional values, solution-focused nursing care, and deployment of professional performance are five categories obtained from the study. The participants believed socially responsible nurses to have positive personality characteristics as well as the necessary skills to do their duties accurately. Such nurses also respect the values, observe the professional principles, and take major steps toward promotion and deployment of the nursing profession in the society. (shrink)

Alan Wallace introduces a natural theory of human consciousness that has its roots in contemporary physics and Buddhism. Wallace's "special theory of ontological relativity" suggests that mental phenomena are _conditioned_ by the brain, but do not _emerge_ from it. Rather, the entire natural world of mind and matter, subjects and objects, arises from a unitary dimension of reality that is more fundamental than these dualities, as (...) proposed by Wolfgang Pauli and Carl Jung. To test his hypothesis, Wallace employs the Buddhist meditative practice of _samatha_, refining one's attention and metacognition, to create a kind of telescope to examine the space of the mind. Drawing on the work of the physicist John Wheeler, he then proposes a more general theory in which the participatory nature of reality is envisioned as a self-excited circuit. In comparing these ideas to the Buddhist theory known as the Middle Way philosophy, Wallace explores further aspects of his "general theory of ontological relativity," which can be investigated by means of _vipasyana_, or insight, meditation. Wallace then focuses on the theme of symmetry in reference to quantum cosmology and the "problem of frozen time," relating these issues to the theory and practices of the Great Perfection school of Tibetan Buddhism. He concludes with a discussion of the general theme of complementarity as it relates to science and religion. The theories of relativity and quantum mechanics were major achievements in the physical sciences, and the theory of evolution has had an equally deep impact on the life sciences. However, rigorous scientific methods do not yet exist to observe mental phenomena, and naturalism has its limits for shedding light on the workings of the mind. A pioneer of modern consciousness research, Wallace offers a practical and revolutionary method for exploring the mind that combines the keenest insights of contemporary physicists and philosophers with the time-honored meditative traditions of Buddhism. Do psychological traits predict philosophical views? We administered the PhilPapers Survey, created by David Bourget and David Chalmers, which consists of 30 views on central philosophical topics (e.g., epistemology, ethics, metaphysics, philosophy of mind, and philosophy of language) to a sample of professional philosophers (N = 314). We extended the PhilPapers survey to measure a number of psychological traits, such as personality, numeracy, well-being, lifestyle, and life experiences. We also included non-technical ‘translations’ of these views for eventual use in other (...) populations. We found limited to no support for the notion that personality or demographics predict philosophical views. We did, however, find that some psychological traits were predictive of philosophical views, even after strict correction for multiple comparisons. Findings include: higher interest in numeracy predicted physicalism, naturalism, and consequentialism; lower levels of well-being and higher levels of mental illness predicted hard determinism; using substances such as psychedelics and marijuana predicted non-realist and subjectivist views of morality and aesthetics; having had a transformative or self-transcendent experience predicted theism and idealism. We discuss whether or not these empirical results have philosophical implications, while noting that 68% of our sample of professional philosophers indicated that such findings would indeed have philosophical value. We examined the links between moral identity—the centrality of moral principles to identity—and political purpose during emerging adulthood. We analyzed data from two waves of a longitudinal study of civic purpose. T1 surveys were collected before high school graduation and T2 survey were collected two years later. We categorized people (N = 1,578 at T1 and N = 480 at T2) into political purpose groups based on the person-centered perspective and then performed multinomial logistic regression analysis to test whether moral (...) identity was associated with categories of political purpose. The findings from our study indicate that moral identity at T1 is linked with the maintenance and formation of T2 political purpose. (shrink)

Laudan constructs a fresh approach to a longtime problem for the philosopher of science: how to explain the simultaneous and widespread presence of both agreement and disagreement in science. Laudan critiques the logical empiricists and the post-positivists as he stresses the need for centrality and values and the interdependence of values, methods, and facts as prerequisites to solving the problems of consensus and dissent in science.

This essay contains a partial exploration of some key concepts associated with the epistemology of realist philosophies of science. It shows that neither reference nor approximate truth will do the explanatory jobs that realists expect of them. Equally, several widely-held realist theses about the nature of inter-theoretic relations and scientific progress are scrutinized and found wanting. Finally, it is argued that the history of science, far from confirming scientific realism, decisively confutes several extant versions of avowedly 'naturalistic' forms of scientific (...) realism. The purpose of this study was to test whether personal commitment to community was related to political involvement in two cultural contexts: Italy and the USA. Participants were 566 adolescents (48.2% males) aged 14–19 years (M = 16 years; SD = 1.29): 311 Italians and 255 Americans. Participants filled out a self-report questionnaire. Analyses of variance revealed that American high school students reported higher levels of personal commitment to community than did their Italian peers and that many forms of political (...) involvement were significantly more common among American adolescents. Structural equation modeling analyses revealed that personal commitment to community was strongly and positively associated with involvement in political activities in both adolescent samples. Thus, fostering personal commitments to community could potentially lead youth to political engagement. (shrink)

The late Jacob Klein’s important book is, remarkably, a lucid presentation of esoteric argument. Dealing with the famed Platonic triad, Theaetetus, Sophist, and Statesman, Klein settles the dispute about the missing dialogue, "The Philosopher," by first denying that it is missing and second showing that it is unnecessary. He argues, in short, that the triad is a dyad. That argument is reinforced by the distinction Klein strongly implies between the Socratic Theaetetus and the Eleatic Sophist and Statesman. "We can now (...) understand why the conversations of the ‘trilogy’ occur in two, not three, days and why the Sophist, the Statesman, and the Philosopher are dealt with in two, not three, dialogues". This book consists of a collection of essays written between 1965 and 1981. Some have been published elsewhere; others appear here for the first time. Although dealing with different figures and different periods, they have a common theme: all are concerned with examining how the method of hy pothesis came to be the ruling orthodoxy in the philosophy of science and the quasi-official methodology of the scientific community. It might have been otherwise. Barely three centuries ago, hypothetico deduction was in (...) both disfavor and disarray. Numerous rival methods for scientific inquiry - including eliminative and enumerative induction, analogy and derivation from first principles - were widely touted. The method of hypothesis, known since antiquity, found few proponents between 1700 and 1850. During the last century, of course, that ordering has been inverted and - despite an almost universal acknowledgement of its weaknesses - the method of hypothesis (usually under such descriptions as 'hypothetico deduction' or 'conjectures and refutations') has become the orthodoxy of the 20th century. Behind the waxing and waning of the method of hypothesis, embedded within the vicissitudes of its fortunes, there is a fascinating story to be told. Normative naturalism is a view about the status of epistemology and philosophy of science; it is a meta-epistemology. It maintains that epistemology can both discharge its traditional normative role and nonetheless claim a sensitivity to empirical evidence. The first sections of this essay set out the central tenets of normative naturalism, both in its epistemic and its axiological dimensions; later sections respond to criticisms of that species of naturalism from Gerald Doppelt, Jarrett Leplin and Alex Rosenberg.

The _Platform Sutra_ records the teachings of Hui-neng, the Sixth Patriarch, who is revered as one of the two great figures in the founding of Ch'an (Zen) Buddhism. This translation is the definitive English version of the eighth-century Ch'an classic. Phillip B. Yampolsky has based his translation on the Tun-huang manuscript, the earliest extant version of the work. A critical edition of the Chinese text is given at the end of the volume. Dr. Yampolsky also furnishes a lengthy and detailed (...) historical introduction which contains much information hitherto unavailable even to scholars, and provides the context essential to an understanding of Hui-neng's work. He gives an account of the history and legends of Ch'an Buddhism, with particular attention to the traditions associated with Hui-neng, quoting or summarizing the most important narratives.
